Information for Third-Party Travel Agents, Travel Wholesalers, Resellers, Dive Shops and Other Groups and Organizations
Under the U.S. economic embargo of Cuba, travel to Cuba by U.S. citizens for tourism is strictly prohibited, however, the US Government permits licensed "People-to-People" educational trips. Ocean For Youth’s Cuba Group Travel Program is in partnership with the Jardines Aggressor I and II, owned by a Panamanian Company and under a special educational program licensed by the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) under 515.565(b)(2) of the Cuban Assets Control Regulations, 31 CFR Part 515 (the “Regulations”).
Under OFAC regulations, there are specific procedures and guidelines that must be followed by travel agents, travel wholesalers/resellers, dive shops, and other groups and organizations that wish to promote and advertise Cuba trips.
Under this program, "each traveler must have a full-time schedule of educational exchange activities that will result in meaningful interaction between the travelers and individuals in Cuba." Oceans For Youth has designed a full-time educational schedule in which travelers are required to participate, in compliance with the US Government rules for travel to Cuba.
Commissions and Payments
As a third-party travel agent, travel wholesaler/reseller, dive shop or other group or organization, you are eligible to receive a commission/referral fee and/or free spaces for groups of travelers that you refer.
According to regulations: The advertiser (travel agents, travel wholesalers, dive shops) may collect, organize, and provide to the Licensee (Oceans For Youth) basic contact information from individual potential travelers, and the Licensee may pay the advertiser a referral fee for doing so. However, unlicensed parties, including the advertiser and retail travel agents, are not authorized to provide Cuba travel-related services on behalf of the Licensee. For example, they may not register the travelers or collect funds from the travelers to forward to the Licensee. Only authorized persons may handle Cuba travel-related funds."
This means that Oceans For Youth must collect all fees directly from travelers and will then pay a commission/referral fee to the wholesaler, travel agency or dive shop. A portion of each traveler's fee is considered a tax-deductible donation to Oceans For Youth, which is used to support research and conservation projects in Cuba. Travelers will receive the appropriate documentation for IRS. The referral fee is paid once 100% of the payments for the Cuba Travel Program are received 90 days prior to departure.

Advertising of Oceans For Youth Cuba Travel program is permitted by third-party travel agents, travel wholesalers/resellers, dive shops, etc. This includes advertising across the spectrum of advertising media, such as magazines, newsletters, emails, web sites, as well as promotion at "information outreach" events, such as conferences and trade shows. However, the following regulations/guidelines must be followed:
According to regulations, "All advertisements must state the name of the Licensee that is conducting the travel." The Licensee in this case is Oceans For Youth, a Georgia USA based nonprofit organization.
Because OFAC does not authorize activities that are primarily tourist oriented, advertisements and representations of the program must be clear that this is an educational program and take care not to promote what appears to be a standard tourist oriented trip. As stated earlier, regulations require that "each traveler must have a full time schedule of educational exchange activities..." Advertisements or representations must not imply that travelers may design their own travel program or depart from the group once in Cuba.
